By accessing and using the e-commerce website comehome.com.vn ("Website"), you agree to be bound by the following terms and conditions of use and purchases ("Terms and Conditions"). The Website and its associated documents and content are provided solely for the purpose of providing information to customers regarding the terms and conditions of use and purchases on the Website. These Terms and Conditions apply to all products and goods sold by us on the Website.

Please read these Terms and Conditions carefully prior to placing an order on this website. We look forward to receiving cooperation from Customers to build an ever-more-perfect Website in order to serve Customers more effectively.

Definition:

The terms listed below, unless otherwise specified, have the following definitions in these Terms and Conditions:

"We" or "Come Home" is a registered trademark of EB BINH DUONG CO., LTD, a company founded and operating in accordance with the laws of Vietnam under the Business Registration Certificate No. 3702058398 issued by the Binh Duong Business Registration Office. Its head office is located at 555B, Binh Duong Boulevard, Zone 1, Hiep Thanh Ward, Thu Dau Mot City, Binh Duong Province, Vietnam.

"Website" refers to the comehome.com.vn website, which is owned and operated by EB BINH DUONG CO., LTD for the purpose of selling Products/Goods to Customers.

"General Transaction Conditions" refers to the terms and conditions of use and purchase on the Website, as outlined in Appendix 1 of these Rules.

"Customer" refers to any organization legally operating in Vietnam or any individual on the territory of Vietnam who is at least 18 years old or who is younger than 18 but is under the supervision of a parent or legal guardian and makes a purchase on our e-commerce website. The Customer may choose to become a Member or not, and may purchase Products/Goods or use services offered on the Website.

"Account" refers to a user account created by a Member who is a Customer on the Website, logged in, and used by that customer to make purchases there.

"Contract" refers to a written agreement between the Parties regarding the establishment, modification, or termination of rights and obligations in particular relationships.

"Order" refers to a request made by a Customer to purchase Products/Goods offered by us through the Website. An Order becomes a legally binding contract/agreement between us and the Customer once We confirm it with an Order Confirmation.

"Cart" refers to a list of products or goods that the customer has chosen and intends to order, along with details about the quantity and cost of each item. The Cart may be modified until the Customer successfully places an order.

"Products/Goods" refers to the products and goods that We occasionally make available on the Website.

"Discount Code" refers to a series of alphanumeric and/or numeric characters and/or numbers issued by us and used to reduce the amount paid by the Customer when purchasing Products/Goods on the Website.

"Working Days" refers to weekdays, excluding Saturdays, Sundays, and any other public holidays in accordance with Vietnamese law.

"Order Confirmation" refers to an email, and/or phone call from the Website, and/or a text message sent to the email address and/or "Website" and/or phone number provided by the Customer at the time of placing an order to confirm the Order.

"Force Majeure" refers to circumstances beyond Our control, such as natural disasters (like hurricanes, floods, droughts, and earthquakes), insurrections, riots, government violence, war, hostilities, warlike activities, national emergencies, terrorism, strikes, epidemics, fires, explosions, accidents, machinery breakdowns, traffic restrictions, communications, third parties' actions (like hackers), and third-party software related to the Website that isn't functioning, shortages of goods and/or services, disruptions in the delivery of public utilities (such as electricity, water, telecommunications, etc.), communication, or the Internet, and/or other situations allowed by Vietnamese law.

1. Introduction

We, EB BINH DUONG CO., LTD., headquartered at 555B, Binh Duong Boulevard, Zone 1, Hiep Thanh ward, Thu Dau Mot city, Binh Duong province, Vietnam, are the website's management and operations unit.

2. Effect, Amendment

  • Customers who purchase Products/Goods from us on this E-commerce Website are subject to these Terms and Conditions. Before placing an order for Products or Goods on the Website, a Customer must confirm that they have read, accepted, and agreed to be bound by these Terms and Conditions.
  • It is hereby declared that the Terms and Conditions may be modified by the entity in charge at any given time, at their sole discretion, in accordance with their policy and applicable laws. The changes shall be deemed effective upon their update on the Website. All orders made by the Customer shall be subject to the updated Terms and Conditions.
  • Failure to accept the updated Terms and Conditions will result in the cancellation of the Customer's Order. Please check the Terms and Conditions frequently on the Website to stay informed of any updates.

3. Guidelines for using the website

3.1 Steps for logging into your account:

    • Step 1: Customers select the region or city where the goods will be delivered.
    • Step 2: To continue with account login, select “ ”  as detailed below.
    • Step 3: The customer must enter their phone number, password, and OTP code to verify their phone number and fill out the required fields.
    • Step 4: The customer has successfully logged in. The screen will display as below:

3.2 We agree and respect the Customer's search and reference to the information displayed on the Website on the computer screen, as well as the Customer's online shopping, at all times, provided that the Customer's activities are in accordance with the Terms and Conditions and the laws of Vietnam.

3.3 Customers are forbidden from acting in a manner that is against Vietnamese law by using Our Website, particularly not by doing any of the following:

3.3.1 Make comments or reviews to other customers or us that are offensive, intrusive, defamatory, threatening, annoying, or otherwise unethical.

3.3.2 Making comments that promote, oppose, or misrepresent the State of the Socialist Republic of Vietnam's policies, or that are biased against a person's religion, gender, ethnicity, or class.

3.3.3. Spreading perverse cultural products with content against respectable customs and traditions or against Vietnamese legal requirements.

3.3.4. Sharing information and enticing others to engage in illegal activity.

3.3.5. Restricting another customer's ability to use their account on the website.

3.3.6. Engaging in any illegal activity involving the internet, open telecommunications networks, or, more specifically, the use of another person's intellectual property without permission, as well as any other legal violations.

3.3.7. Commit acts, fabricate information, purposefully cause misunderstandings with other customers, or pose as the website's administration.

3.3.8. Interfering with or disrupting the website's connection to the internet or other informational pages or websites.

3.3.9. Should any such behavior be discovered, We reserve the right to immediately lock or terminate the Customer's User Account and take any other necessary legal action.

3.4. Regulations for using other websites

Customers use other websites connected to our Website on social networks (such as Facebook, Instagram, Zalo, etc.), (if any) should be in accordance with our Terms and Conditions of those websites, social networks, and Vietnamese law.

4. The process of ordering products or goods

Basically, the steps involved in placing an order on the website are as follows:

  • Step 1: Go to https://www.comehome.com.vn to access the e-commerce website.
  • Step 2: Customers select the region or city where the goods will be delivered.
  • Step 3: Customers choose the product category they wish to purchase.
  • Step 4: Customers browse, view, and choose the items they want to add to their shopping cart from the list of products they have chosen.
  • Step 5: Customers can modify the quantity they wish to purchase on the following screens.
  • Step 6: Before proceeding to the next step, the Customer must review the Cart containing the Products/Goods that they have chosen. Choose to modify (add/remove/delete) the Products/Goods in the Cart (depending on the Customer's needs).
  • Step 7: Once the customer clicks the "Buy" button, it goes to the delivery details page. 
    • 7.1. Address and delivery information: Customer provides information and delivery address (if Customer has not yet created an account); or choose the default address/ Add a new one (if the customer has already created an account on the site).
    • 7.2. Pick a delivery time: Customers choose the most appropriate delivery date and time. The customer can select the service and installation time if the cart contains products that need to be measured and installed.
  • Step 8: After clicking the "Next" button, the screen will switch to the payment method selection page. There are 2 options: Cash payment - cash on delivery (COD) or VNPAY QR/ATM card/bank account.
  • Step 9: If your payment goes through successfully, the website will revert to the Order Successfully page.

5. Price and Order Acceptance/Rejection

  • 5.1. We make every effort to provide customers with accurate images of products
  • or goods, and we only sell authentic products or goods of the highest quality and at a reasonable price.
  • 5.2. The customer will see a message on the screen confirming a successful order when the order is completed.
  • 5.3. We constantly work to ensure that the prices of the products/goods displayed on the website are accurate. The Customer will be contacted to confirm the amount of the Order as part of the process to accept the Order, but in some instances where there is an error in the display of prices on the Website, we may, on a case-by-case basis, contact the Customer to confirm the value of the Order to ensure that the Customer still wants to buy the chosen Product(s) at the correctly adjusted price.
  • 5.4. Additionally, we reserve the right to refuse or cancel any order, regardless of whether it has been confirmed or paid for, if it is the result of a force majeure event, a product or good that the customer selected being out of stock for reasons beyond our control, or incorrect commercial information entered on the e-commerce website comehome.com.vn.
  • 5.5. In the case of inaccurate information appearing on the Website that We can demonstrate to be the result of the system or from a third party (wrong product price, wrong origin, etc.), We will provide the Customer with a discount code for later purchases as compensation on a case-by-case basis and reserve the right not to complete a faulty transaction.

6. Payment

6.1. Payment methods

6.1.1. We accept the following flexible and secure payment options:

I. Cash on delivery (COD):

The Customer pays the Order's value in cash to us or our agents after checking and receiving the Products/Goods of the Order. We only accept COD for orders that total less than twenty million VND (20,000,000VND). Following is the procedure for COD payments:

    • Step 1: Customers place orders by choosing the items they wish to purchase and then clicking the "Buy" button on the Cart page.
    • Step 2: Customers select a payment method and enter their delivery information: Cash-COD
    • Step 3: The website will revert to the Order Successfully page.

II. Pay online using VNPAY Payment Gateway.

We accept online payments using VNPAY Payment Gateway. for all orders that do not include "Fresh Food." The Customer shall pay the full amount of the Order at the time of the Order by providing the necessary payment information as outlined below:

    • Step 1: Customers place an order by choosing the item they wish to purchase and then clicking the "Buy" button on the Cart page.
    • Step 2: Customer selects payment method via VNPAY Payment Gateway. after filling out delivery information.
    • Step 3: After clicking "Purchase," the website will switch to the VNPAY Payment Gateway.
    • Step 4: After a customer successfully processes a payment with the VNPAY Payment Gateway, the website will go to the Order Successfully page.

6.1.2. The Customer warrants that all information relating to the payment of the Order is accurate. We reserve the right to verify the Customer's payment information prior to the delivery of Products/Goods. If the Customer has provided inaccurate information, we have the right to cancel the Order.

6.1.3. We will refund customers who pay cash on delivery at a pick-up location in our system in cash or by bank transfer. In this instance, the refund will be processed via bank transfer and applied to the customer's wallet in accordance with the data they provided. The accuracy and legitimacy of the account number that the customer has given us are their responsibility. We'll cover any transfer fees, if there are any.

Particularly for orders paid for with domestic ATM cards or e-wallets, we only make a refund to the cardholder's or e-wallet holder's payment account.

7. Delivery of Products

7.1. After the Order is successfully placed on the Website, We will prepare the Products/Goods for delivery that the Customer has ordered at the store/location on our website. 

7.2. The time to prepare the goods will vary based on the time of ordering and objective conditions such as weather and traffic but will be a minimum of two hours (02) for orders placed before 20:00 and before 10:00 the following day for orders placed after 20:00.

7.3. If there is a delay in the delivery of the goods, we will, to the extent permitted by law, inform the customer. In this case, the customer has the right to refuse and cancel the order without incurring any fees.

7.4. For exchanges, returns, and other requests, the Customer should keep the delivery note.

If a customer has found any issues with a product they purchased on comehome.com.vn, they can request an exchange through the e-commerce website or by calling the hotline. Come Home is responsible for resolving the customer's request effectively and thoroughly and protecting their interests.

Instructions and requirements for checking Products/Goods can be found on the website in the Service -> Exchange Policy page.

7.5. Products/Goods are packaged using our standard packaging. If the products or goods are oversized or bulky, we may reuse the packaging in accordance with the instructions provided by the manufacturer or supplier to the customer. If the customer requests that the goods be packaged differently, we might agree to their request and charge them an additional fee (if any).

7.6. Before stocking some products/goods, we will carry out an external physical quality check procedure to make sure the products/goods are still intact without any external impact or internal technical interference.

7.7. Any claims regarding the Product/Goods must be made by the Customer within 30 days of receiving the products/goods (Refer to details, please go to Service -> Exchange Policy).

8. Exchange Policies

9. Account and Personal Data

9.1. Account:

9.1.1. Customers can choose whether or not to create an account when ordering goods or products from the website, as detailed in Section 9.

9.1.2. All organizations legally operating in Vietnam or any individual on the territory of Vietnam who is at least 18 years old or who is younger than 18 but is under the supervision of a parent or legal guardian, are permitted to create accounts and make purchases on our Website.

9.1.3. To log in and use the Account on the Website, the Customer must provide one (01) phone number to receive the One-Time Authentication Password (OTP). We advise Customer not to reveal this password to any third parties.

9.1.4. Upon discovering a violation of any provision of these Terms and Conditions or of Vietnamese law by the Customer, We may immediately lock, suspend, or cancel the registration of the Customer's Account. We may also take other necessary actions in accordance with Vietnamese law if we discover any loss or damage resulting from the Customer's violation of the Terms Conditions.

If the Customer does not accept any of the contents of the Terms and Conditions, our principles, regulations, policies, practices, or support, the Customer has the right to stop using the utilities and services we provide on the Website and not to place an order.

9.1.5. Suspension, cancellation of Customer’s Account registration, and right to access the Website have no effect on other Customers' rights and obligations.

9.2. Personal Data

9.2.1. When registering to create a new Account or whenever accessing the Website, the Customer provides us with complete and accurate personal information, including phone number, full name, gender, date of birth, email address, shipping address, etc.

The Customer has full rights and responsibilities with regard to the personal information provided by the Customer (including Account, password, etc.), and all of the Customer's activities on the Website will be performed using this information. The Customer must notify us immediately at 1800 9101 or support@comehome.com if he or she notices any indications of unauthorized use of his or her Account and personal password to receive timely assistance.

9.2.2. The purpose and scope of the use of personal data:

9.2.2.1. All of the customer's personal information is used by us to process orders, deliver products/goods ordered on the website to the address specified by the customer, provide information about the products/goods, support account management for the customer, enhance website features, etc. We reserve the right to decline to conduct business with a customer whose personal information is inaccurate or causes challenges for us in providing service to the customer.

9.2.2.2. Depending on the personal data the customer has provided (such as email, phone number, address, etc.), we may send promotional information or information about the products/goods we provide on the website to the customer with their permission.

9.2.2.3. In some cases, such as delivery, installation of the goods or products, or obtaining payment from the customer, we may provide personal information that the customer has given us to a third party.

9.2.3. The Customer's personal information will be stored until a cancellation request is received or the Customer logs in and cancels themselves. In all other cases, We will retain the personal information of Customers for as long as required by law or as long as the information continues to fulfill the purpose and scope of use outlined in these Terms and Conditions.

10. Confidentiality

10.1. When customers do any transactions on the website, we prioritize the security and safety of all customer information (including personal information, delivery information, payment information, and so on) by using the most advanced technologies and supporting measures.

10.2. The customer's personal information is only used to fulfill their requests or for other purposes for which they have given their consent, and it is never transferred, given, copied, or used in any other way that would violate the law or be commercially beneficial to a third party.

10.3. If required, it is our responsibility to provide personal information and transaction details about Customers to the appropriate State authority or organization.

10.4. The Customer's payment information will be encrypted throughout the entire order process for security reasons. Safe mode will automatically exit once this process is complete.

10.5. We utterly disclaim all liability for any damage or loss that may result from the Customer's failure to adhere to the information security requirements outlined in these Terms and Conditions (including the confidentiality of payment information).

10.6. No individual or organization may interfere with, edit, or change the data structure of the Website, whether through tools, applications, programs, or any other means. According to Vietnamese law, all activities of propagating, promoting, or spreading illegal acts for the purpose of infiltrating, copying, storing, or destroying system data on the Website are strictly prohibited. When necessary, we will request that the competent State agencies deal with the individuals or organizations that commit this violation in accordance with the law.

11. Rights and obligations

11.1. Our Rights

In addition to the rights and responsibilities outlined in other sections of these Terms and Conditions, We also have the rights and responsibilities listed below:

11.1.1. We're committed to conducting business on the Website in accordance with Vietnamese law;

11.1.2. In the event that the ordered Goods/Products are unavailable for any reason or due to Force Majeure, we reserve the right to refuse the customer's orders;

11.1.3. We reserve the right to request the Customer's personal information when opening an Account, making payments, and in other necessary situations (such as when delivering the Customer's Orders);

11.1.4. In accordance with Vietnamese law, we will make use of the Customer's personal data provided to us, as well as the Customer's reviews and comments posted on the website or on other social networking sites that connect to the website in order to:

    • Serving Customers' Orders; 
    • Improving the Quality of Customer Service; 
    • Other Purposes in Accordance with the Law.

11.1.5. We will disclaim all liability in the following situations:

    • Your computer, devices, software, applications, or internet connection are incompatible with the Website.
    • Technical problems include incorrect or erratic page loading due to Force Majeure events, excessive website traffic, an inappropriate or unstable customer internet connection, and/or other causes beyond Our control;
    • The website's content, including the information that was searched for, did not adequately address the customer's needs, or only partially did so;
    • To the extent permitted by Vietnamese law, We shall not be liable to any third party for accidental or intentional damages (including, but not limited to: loss of revenue, loss of profits, cost, loss, loss of privacy, and data loss) or any indirect damage arising from the Website.

11.2. Customer’s Rights

11.2.1. Individual customers must be at least 18 years old or younger than 18 with parental or legal guardian consent and supervision. When making purchases on When making purchases at Our Website, a customer who is an organization must be able to legally operate in Vietnam;

11.2.2. The Customer is responsible for providing Us with accurate and truthful personal information, and is solely responsible for the accuracy of this personal information;

11.2.3. The Customer is fully responsible for paying the full amount of the Order placed on our Website.

11.2.4. The Customer is responsible for strictly adhering to our recommendations and notices in Section 6 of these Terms and Conditions.

11.2.5. When using the Website, the Customer understands and agrees that there may be risks involved with using a computer, the internet, or another telecommunications network.

12. Intellectual Property Rights

  • We own the rights to all of the information on the Website, including all text, images, sounds, videos, software, applications, and source code. 
  • The Customer is solely responsible for respecting all of the Website's content, images, and other information. We forbid the use, duplication, modification, or distribution of any portion of the Website or its intellectual property without our written permission or consent, including for any commercial business, advertising, referral, or third-party representation.

13. Customer Care

13.1. We make every effort to provide our Customers with the best Products/Goods within the allowed scope. However, We cannot guarantee that each of these Products/Royals is appropriate and completely satisfies the Customer's requirements.

13.2. We cannot guarantee that the ordering services and utilities offered through our website are completely error- and problem-free. If you encounter an error while using our service or ordering system, please contact our Customer Support immediately at 1900 9101 or email to support@comehome.com.vn so that we can take reasonable and timely corrective action.

13.3. Occasionally, access to the Website may be limited for the purposes of repairing, maintaining, or implementing new services, utilities, or applications on the Website.

13.4. We do not supply or support computers, software, internet connections, or any other hardware needed to access the Website as part of the services and utilities we offer.

13.5. Your computer or other device must be connected to the internet or the proper telecommunications links in order to access and use the website. We are not liable for any fees incurred during the Customer's use of and access to our website.

14. Governing Law and Dispute Resolution

All of these Terms and Conditions, any successfully placed orders, as well as the website's content, regulations, and policies, are governed by Vietnamese law. If a dispute arises from the use of the website or the purchase of Products/Goods from the website, it will be prioritized for resolution through negotiation and mediation. In the event that mediation is unsuccessful, a Vietnamese court with the necessary jurisdiction will handle the case.
